TERMS AND CONDITIONS OF USE ("Terms & Conditions")
Overlake Medical Center and Overlake Medical Clinics ("Overlake") are pleased to offer you access to MyChart, an easy to use web-based version of our electronic health record. MyChart enables you to access your health information from anywhere at any time. These Terms & Conditions outline the practices of Overlake and our commitment to your right to privacy.
After ensuring that we have all the necessary information, you will be provided your set up instructions which include a unique access code or link.
General Principles -
•You understand and agree that access to MyChart is subject to these Terms & Conditions.•You understand that for all medical emergencies you should seek emergency medical attention at your closest emergency department, or by calling 911.•You are requesting access to MyChart for personal use only.•You understand that the health information included in MyChart may include health information that you consider very personal, including information about sexually transmitted and other communicable diseases, drug and alcohol abuse, HIV/AIDS, and mental health services. Your health care provider, its employees, officers and physicians are hereby released from any legal responsibility for liability for disclosure of the above information to the extent indicated and authorized herein.•You may choose to discontinue use of this service at any time and no further action is required.•You understand that failure to comply with the Terms & Conditions for MyChart may result in termination of MyChart access privileges.
Your Health Record -
As Overlake provides your health care, we are required to maintain documentation of your health history, current conditions, treatment plan, and all treatments given, including but not limited to the results of all tests, procedures and therapies. All electronic health record information is subject to all state and federal statutes governing the security and confidentiality of health records.
Please keep in mind that the health information presented through MyChart does not include all the health information available in your permanent electronic health record that Overlake maintains about you. The posting of your health information is limited by the MyChart service and further at the discretion of your provider(s). Moreover, be advised that the information you communicate through the MyChart service may not be incorporated into your permanent electronic health record.
If you use the MyChart service, you may receive messages, test results and other communications delivered via MyChart. Accordingly, your provider(s) will not send duplicate written reports of this information, unless you specifically request a written report in addition to the electronic version.
You should also understand that your messages sent via MyChart may not be delivered directly to an individual provider and may be routed to appropriate members of your provider's staff for processing and response. Accordingly, you should not communicate via MyChart if you desire to communicate sensitive information directly with a specific individual at Overlake.
Your Responsibilities -
By using MyChart, you agree to be bound by these Terms & Conditions. You understand that these Terms & Conditions may be modified from time to time. You agree that it is your responsibility to review the Terms & Conditions and that your use (and continued use) of MyChart shall represent your agreement to be bound by the Terms & Conditions existing at the time of your use of the MyChart service.
You agree that you are solely responsible for your use of MyChart. You agree that you will not utilize the MyChart service to communicate offensive, hateful, defamatory, harassing, or discriminatory speech. You should not share your MyChart access with others. Special care should be taken with any information that you print out of MyChart.
Confidentiality -
Overlake affords the same degree of confidentiality to health information stored on MyChart as is given to health information stored by Overlake in any other medium. Overlake is committed to protecting the confidentiality of your health information. We limit employee access and their ability to enter or view information based upon their role in your care and only to that minimum amount of information necessary to perform their job duties. Firewalls, passwords, encryption, proactive privacy monitoring and audit trails are further used to safeguard your information.
Email Communications -
Overlake may send communications to the email associated with your MyChart account regarding educational or informational communications, such as but not limited to educational newsletters, construction notices and public health announcements. You may also receive email communication to obtain your authorization to receive marketing information. You may opt-out at any time from these communications by following the process as described in this email. By agreeing to these Terms & Conditions, you acknowledge and agree that the use of unencrypted email carries certain risks. For example, email messages could be received by other people who have access to your account or the device that you use to access email. By agreeing to receive communications via email, you acknowledge that these risks exist and expressly consent to receive unencrypted electronic communications as set forth in these Terms & Conditions.
Email Privacy -
As a user of MyChart you should be aware that you will be notified via email when there is new health information to be viewed. This means that any person with access to your email will be able to see this notification. This could include your family members, employer or anyone else who can access your email account. Although no private health information will be sent, the notification that new health information is available by accessing MyChart may be information that you would not want others to know. Thus, you should take this into consideration when providing an email address or using MyChart.
Response Expectations -
Overlake will make its best effort to provide a timely response to electronic inquiries (emails and other electronic communications) transmitted via MyChart. In some cases, the provider(s) and their staff may not be immediately available; therefore, you should allow at least three (3) business days for a response. Accordingly, emergency situations requiring immediate attention should not be submitted electronically, and instead you should call 911.
When communicating with your provider(s) via MyChart, please be as specific as possible and provide an accurate reporting of what is going on and what you are asking your provider. Overlake is only able to respond to electronic communications based on the information you provide. If there is insufficient information provided, we will be unable to provide accurate and reliable communications in response.
Parental Access to MyChart -
Proxy access for a minor’s MyChart account is permitted to individuals who may demonstrate proof of parental status or legal guardianship of the minor. Proxy access to a MyChart account of a minor under age 13 is automatically terminated upon the minor’s 13th birthday. Proxy access to minors between the ages of 13-17 is not permitted to protect the individual’s healthcare rights and to protect specific sensitive information of these individuals in accordance with Washington state law. After a minor’s 13th birthday, the minor will need to complete online medical record enrollment to establish a MyChart account of their own.
If you send us an email communication, it may be shared with the Overlake clinical staff who provide care or assist the provider in providing your health care. Your confidential health information in MyChart will be accessible only to appropriate Overlake providers and staff.

Discontinuing Use of MyChart -
You acknowledge that MyChart is a service offering afforded to you to promote effective communication between you and your provider(s). You agree that your provider(s) are not obligated to offer the MyChart service to you and that your provider(s) may terminate your ability to access and/or use MyChart for any reason, including violation of these Terms & Conditions.
You can discontinue your use of MyChart at any time.
Site access & Licenses -
You are granted a limited, revocable license to make personal use only of the MyChart service via this website and the associated services in accordance with these Terms & Conditions. This license expressly excludes, without limitation, any reproduction, duplication, sale, resale or other commercial use of MyChart and the associated services, making any derivative of MyChart or the associated services, the collection and use of user email addresses or other user information, including, without limitation, health information or any data extraction or data mining whatsoever. Through this license, you may be able to upload third party data into MyChart or download limited health information from MyChart to select third party sites.
We reserve the right in the future to charge a fee for the use of MyChart. You will be notified of this change and asked to re-apply if you agree to the fee and wish to continue with this service.
Security -
This website uses information security safeguards and protections. However, no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. Information will be transmitted over a medium that is beyond our control. YOU HEREBY EXPRESSLY ASSUME THE SOLE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVICE. Once the information is received by us, your health information will be treated as confidential and given the same protection that all other medical records are given.
It is extremely important that you keep your MyChart username and password in a secure location and completely confidential. It is your responsibility to prevent disclosure of your temporary access code and password and to change your password and password hint if you feel that your security has been compromised. We shall not be liable for any damages that results from your failure to keep your password secure. You can change your password online at any time.
Overlake has taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use.
Third Party Healthcare Applications -
At your election, MyChart allows you to share your health information maintained in MyChart with external third party applications (e.g., apps). While MyChart contains tools to help you manage the permissions you may grant to such third party applications to access your health information, the external third party applications may or may not have the safeguards and protections that MyChart does. We do not endorse or validate any third party application for use with MyChart.

MyChart contains links to third party sites operated by other parties. The links are provided for your convenience only. We do not control such websites and we are not responsible for the content and performance of these sites. The inclusion of links to other websites does not imply any endorsem*nt of the material on the websites or any association with their operators. We do not operate, control, or endorse any information, products, or services provided by third parties through the Internet. Use of other sites is strictly at your own risk including, but not limited to, any risks associated with destructive viruses. You are responsible for viewing and abiding by the Terms & Conditions and the privacy statements of the other websites.
No Warranties -
MyChart and the content contained herein and therein are provided on an "As Is" basis. We make no representations or warranties of any kind express or implied as to the operation of MyChart. To the fullest extent permissible by applicable law, we disclaim all warranties, express, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and/or infringement.
Limitation of Liability -
Some of the material in MyChart is provided by third parties and we shall not be held responsible for any such third-party material. We disclaim any responsibility for, or liability related to such third-party material. Any questions complaints or claims related to any product should be directed to the appropriate third party.
Limited English Proficiency -
Currently the electronic information in MyChart service is not available in non-English formats.
Governing Law -
By using MyChart you agree that the laws of the state of Washington, without regard to principles of conflict of laws, will govern these Terms & Conditions and any dispute that might arise from the use of MyChart. You expressly agree that exclusive jurisdiction for any dispute related to the use of MyChart, resides in the courts of King County, Washington and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of King County, Washington. Use of MyChart is unauthorized in any jurisdiction that does not give effect to the Terms & Conditions set forth herein.
Terms and Conditions Revisions -
Overlake reserves the right to periodically revise the MyChart Terms & Conditions. The revised Terms & Conditions will be posted on the MyChart webpage. Your continued use of MyChart confirms your acceptance of the revised Terms & Conditions.
